--our vehicle was in a accident last summer. The other insurance admitted fault. This insurance company wanted to salvage my vehicle. They told me car was worth a very low amount. They never showed written proof, of this value. I refused this offer over the phone and by certified mail. I also provided other car values showing it to be higher. I asked them in writing to fix my car or pay for what car was really worth. They refused. They also in a letter acknolledged reciept of my refusal letter. I had car fixed for 400 more than there offer, but 1,000 less than the lowest value I provided. The statue of limitation on this is not up for 10 more months, due to fact injury was involved. At no time did I accept a settlement on this car, and at no time did they obtempt to obtain my title, infact I have the pink slip.
I registered the car online, I waited for stickers they never came. I called dmv and found out my registration was in suspension, due to fact vehicle had been salvaged.
#1 Insurance company filed fraudulent documents
#2 Insurance company committed perjury on dmv documents
#3 Insurance company committed mail fraud, by mailing documents from arizona to california dmv.
#4 Insurance company committed fraud against me
I am now unable to legally drive this vehicle, and am told by police officer with DMV, this can take 5-6 months to clear up. This same situation happened to officer, and she has seen it on several occasions. Insurance companys do this to tie up your vehicle to force you into taking there offer.
I am waiting now for dmv to send me document filed by insurance company. As soon as I have this I will be pressing criminal charges.
QUESTION; I realize this also is a civil matter, but am wondering if it falls into any other legal suit categories?
Thank-you!!!
