I have an issue that hopefully you can help me with.
My company shipped a package without insurance (the shipper was not told to insure the package) the package arrived to the customer empty. by customer I mean they sent us these items to see if we wanted to by them from them, we did not and we are returning them to them. We are on a special program with FedEx that we can insure up to $50,000 but didn't by mistake. It looks like FedEx did steal the items (jewelry $46,000) but they will not pay the claim because we did not insure.... Let’s say we take FedEx out of the loop, and we have proof (video) that we put all items in box and gave it to our FedEx driver at out office. Who would be LEAGLY responsible? Us to pay the customer or would the customer have to fight it out with FedEx? Would we legally have to pay the customer?
One more thing if we have to pay legally and I get fired because of it but the person who gave me the package did not get fired do I have grounds to sue for wrongful termination? Actually do I have grounds to sue even if the other person got fired too?
