Can a woman leave the state with her child against the farthers wishes when they are not married and there has been no custody hearing..

Dear TrueLawyers Member:

The father has parental rights (Custodial and/or Visitation) and needs to assert them in Court to prevent the mother from taking the child out of state.

Every case has its own unique facts and factors to determine the degree of Custodial and/or Visitation rights, if any, of each parent.

Grandparents also have certain rights to be a part of their grandchild's life.

 

A Court can determine these rights, and determine what is in the best interests of the child.
