slip and fall 

This morning i stopped at Dunkin Donuts to grab 2 coffees.  On my way out i slipped and fell in their parking lot.  I slipped on one of those big yellow arrows they have painted in their parking lots which show you which way the drive thru is.  Oddly i am becoming more and more uncomfortable as the time goes by but the pain isnt in the actual area if hit on the ground. For example i landed on my hip and upper leg and the lower half of the palm of my hand.  My neck and the lower part of my head is hurting, sort of like a headach but at the base of my head and in my neck, also my shoulder and lower arm.  My hip is sore but i can understand that because thats where i landed.  Nothing is broken, im just sore.  If im still uncomfortable in a few days or if things get worse i was wondering if i have a case against Dunkin Donuts.  Ive been told by a few people yes but they are not lawyers and do not know the laws etc....  It was raining out and i was wearing flip flops.  I think the rain made the yellow arrow slicker than it usually is.  The arrows are smoother than the rest of the parking lot which is why i slipped and fell.  Is this just my fault that i fell in the rain or is the company insured for something like this and do i have a case?  Thanks for any information you can give me.  My email address is Debbie13170@comcast.net  At this point id just like to communicate via email or a posting on here if you dont mind.  Thanks again.

Dear Debbiegirl1970,

 

Yes, you definitely have a case.  The real issue is the strength of your case.  To preserve and prepare your case early on in the strongest way possible, it is important that you document as much as possible about your accident for use as evidence to prove your case later on.

For example:

You should be examined by a doctor and seek regular treatment by a chiropractor, physical therapist or other health related professional appropriate for your specific condition.  If you have a family doctor, that is a good place to start and get referrals to others.

If you still have it, save your receipt for the 2 coffees you purchased.  Did you pay with a credit card?  Did you buy gas that day if there is a gas station or other product from another business on the same premises or sharing same parking lot.

You bought 2 coffees, was one cup for a friend that witnessed your fall?

Did you report your fall to anyone at Dunkin Donuts?

Are there surveillance cameras operating on the premises that you could get a hold of that might have a video of your fall?

How has your life/daily routine changed since the accident? (Keep a daily journal or diary of pain & suffering/trials and tribulations)

This is to get you thinking along these lines  -- evidence, witnesses, documented or recorded proof that puts you on the scene around the time you claim to have fallen there.

Medical records, purchase receipts, witnesses and security cameras are just a few common examples.  Anyone you told or who noticed your injuries shortly thereafter can be useful as well.

It is difficult to advise you further or with greater detail tailored to your specific situation while you remain anonymous and further important questions remain to be answered.

 

Bear in mind that the law limits the time you have to file a claim.

Are you a lawyer yourself?  I wonder if you are close to me as i wouldnt want to work with a lawyer thats hours away from me, how oftern would i have to make office visits with you?  I had a lawyer about 5 years ago and i never saw her at all, we did all our correspondence via email, phone, fax and snail mail, is that typical?  How can i contact you personally to find out where you are located etc....  i want to give you my number or call you or something but dont want to post it here.  If you are too far from me can you refer me to someone else closer to me?  if you are far away and i dont need to make trips to your office all the time maybe you can help me?

well i found a lawyer. at first he said he didnt see how dunkin donuts was responsible which made me feel really stupid for calling him in the first place. Then when i explained i had slipped on the yellow arrow pointing to the drive thru he said he knows that those are a different material and thinks there may be something in there as far as it being their fault because of the material being so slippery etc....  I would have felt more comfortable hiring a lawyer that bellieved 100% that i had a case, like you said, but i didnt hear back from you and i want to start my care and the chiropractor said i needed to have a lawyer to start because thats where they send the bills and then the lawyer pays them when we settle the case.  Thank you for all of your help and information, wish we could have talked more and i could have worked with you.
