Liability
I have a question I hope some one can help me with.  First I will explain the situation.  I own a carpet cleaning buisness I damaged a persons carpet and I have liability insurance for personal injury and property damage.  The insurance company will not help me out because of the fine print.  The way I clean carpet is comonly refered to as a dry carpet cleaning (truely it is low moistue) . I did a job at a residentual house and the carpet was a twist carpet were the fibers are just twisted togeather.  My equiptment spins so it untwisted the fibers.  Th customers warinty recomends to hot water extract (Steam clean) the carpet, when I asked a carpet mill about this type of carpet the mill told me that if any other method of cleaning the carpet is used it invalidates the warrinty.  SO I am wandering am I completly responsible for the carpet, half way or not at all?  To me it is similar to having a shirt that says do not dry clean, if you take it to the dry cleaners in my mind it would be your fault because you were given the care directions and asked for the wrong service.  Plus as a carpet cleaner thier is no tag sticking out that I can read, this is knowledge that the owner had.  If some one could give me thier thoughts from a legal stand point I would apriciate it, should I go to small claims and fight it, or settle out of court for the full price of the carpet, or a percentage of the price (if so what percentage) the carpet was about 2 years old first cleaning)?
