contract labor

I work for a physician and I was told after I was hired that I was hired as a contracted laborer.  I work in his office 3 days a week under his supervision and I am paid by the hour every 2 weeks.  I was trained by the former "assistant" who left.  He contols the hiring & firings.  I asked him to be put on payroll and was denied because I am a contract laborer.  I basically am the secretary/biller for his office.  I am partially reimbursed for my parking expenses and my paycheck is generated from his business account.  I have been employed there since June 2007.  I am docked an hour of pay if I take lunch.  Do I fall in this category of "contract labor"?  I told him that I do not, but he disagrees.
