I just had an operation on 6/8/2007.This was my second surgery for a neck injury that happend on the job back in 2001.In 01 I had a cervical fusion of c6 - c7.This time I had the old plate removed and 2 more levels above fused.I had no problems with the first surgery,and it helped with some of the symptoms.I had hurt my right arm ,and neck.These were causing bad headaches ,neck pain ,and pain in my right arm.
This time it was the same issues again ,and I had the surgery.After this surgery instead of things getting better,I have lost range of motion ,and severe muscle weakness in my LEFT arm.I was rushed into the doctors office today and examined.He said this is a danger with the levels that were fused this time,and has ordered a new MRI.
My question is this.Since I had none of these problems with my left arm before the surgery.Who is responsable for this? Travelers Insurance is the workerscomp insurence,but must approve the new MRI.I think the are going to have a real problem with this.Since this all came about as a result of the surgery. Who will be the party that has to pay for fixing this? The workerscomp pepole or the doctor?I already went to court and won this case,but Im worried now. I think I may end up between the two pointing fingers at each other.
