NEW HOME WON'T PASS LOCAL INSPECTION 

My husband, now ex, and I built a home.  It is a very expensive home, in fact one of the most expensive in all of our area.  The home is three stories and overlooks the river.  It has solid windows on the side overlooking the rivers, on every floor in every room, it is windows from the ceiling to the floor.  At any rate, I now find out, that the builder only put in single paned glass windows and that the building codes here require double paned windows.  The local codes have not changed since we contracted with him on a cost plus contract.  Now, I am divorced and faced with the fact that the house will not pass inspection because of the single paned windows.  Do I have cause for a lawsuit against the builder and how do I go about doing this? Does Tennessee have triple damages in Real Estate Suits, as Texas and some of the other states do?  How long do I have to file the suit?  The house is to be sold and the proceeds split between my ex husband and myself.  Does he have to be part of the lawsuit?  Please advise asap.
