Called to be a hearing witness by ex-employer. Can a charge a "consulting" fee?

Much to my dismay I my employment was suddenly terminated after 32 months a Fortune500 on Nov. 15th as a result of showing a vacation slide shown at an after-hours function while traveling, that had some risque pics in it.  Fired for "professionalism" for showing the pics, and for "not cooperating with an investigation" once I realized I needed an attorney and stopped answering their conference-call questions.

I just received a call on Friday from my exmanager asking for me to work with them and their attorney on two year old unrelated discrimination complaint that I am a key witness to, that apparently is going to hearing.

Do I present them with a consulting agreement?  How much do I charge?

I also may want to sue for severence as there were numerous unusual aspects to this including a 2007 company calendar displaying a man wearing no pants, as well as a written concern (documented in email to my manager) I raised in Septemer regarding imporper written company procedure for filling out important government forms in preperation of an audit..
